The terms and conditions written in this document are agreed by CBRA Genomics, S.A. based at Biocant Parque Tecnológico, Núcleo 04, Lote 3, 3060-197 Cantanhede, with the fiscal identification number 510 447 147 and contact +351 231 410 890 hereinafter referred to as  “CBR Genomics“ and persons (collective or natural) with an interest in the performance of the service, hereinafter referred to as" User" (or "users").

 

We are committed to ensuring the confidentiality of the information we collect. Respecting this commitment, we want you to know why we collect your personal data, how we treat them, how to protect them and how to present questions.

 

The availability of personal data under the use of Software as a Service  that allows video consultations, hereinafter referred to as "Panacea", implies the knowledge and express acceptance of the conditions set out in this document.

 

OBJECT

This document of terms and conditions and privacy policy regulates the collection and processing of personal data of the user in the scope of Panacea, by CBR Genomics which reflects the highest of concerns about privacy and processing of users’ personal data. The privacy policy shall communicate to users’ information on the exercise of their rights relating to personal data, pursuant to 2016/679, of April 27, General Regulation on the protection of personal data ("GDPR”), as well as Law No. 58/2019 of 8 August.

 

RESPONSIBLE FOR DATA PROCESSING

The person responsible for the treatment of data is CBR Genomics, health care provider, through video consultation. To do this, CBR Genomics subcontracted the company SEEMS POSSIBLE, LDA. - KNOK, which develops and manages Panacea software, hereinafter KNOK.

COLLECTION AND DATA PROCESSING

Access to Panacea presupposes the collection of the following personal data from the user:

      Full name

      E-mail address

      Phone number

      Date of birth

      Biological sex

      Fiscal no. (optional).

 

In the case of health professionals, the following data are collected:

      Full name

      E-mail address

      Phone number

      Professional ID number

      Personal information present on the Professional Public Profile Page

      In the case of administrative employees of CBR Genomics with access to Panacea, their full name and e-mail address are collected.

 

During the provision of the service, the health professional may collect data relating to the health of customers who are attending.

TREATMENT AND LEGAL BASIS

To provide sought after health care, we collect and treat personal data, including health information, for health care, preparation of medical diagnoses and / or health or preventive medicine or work, or for the management of health systems and services.

In addition, through Panacea are used the Personal Data required to give access to the completion of the consultation by digital means.

 

The legal basis for the treatment of Personal Data includes treatment:

      Necessary for medical diagnosis, care or health care and health systems or health services;

      Required for compliance with the company's legal obligations, including the provision of services to patients and customers.

      Necessary for the legitimate interests of the company.

      Necessary for the establishment, exercise or defence of a right in a judicial process.

      Necessary to protect the vital interests of the data holder or other natural person.

      Necessary for reasons of public interest in public health; or,

 

If the user has given his consent, which may be subsequently withdrawn without affecting the legitimacy of the treatment affected based on previously given consent.

WITH WHOM WE SHARE YOUR DATA

As mentioned above, Panacea is managed by the company SEEMS POSSIBLE, Lda. - KNOK, which acts as a subcontractor, treating personal data on behalf of CBR Genomics.

Our health professionals respect the Codes of Ethics of the occupational classes to which they belong, which are very demanding as regards the guarantees of confidentiality. Because they work as a team, to be able to provide you with the best health care, our health professionals will be able to share your personal data. If you seek services from a health care provider that is not part of our company, we can share information with the team of health professionals from the provider by itself, thus ensuring the continuity and quality of your service. Considering the activity we have developed in the scope of health, sometimes we are obliged by law, and always within the stipulated limits, to transmit certain information to public entities, such as the Health Regulatory Authority (ERS – Entidade Reguladora da Saúde). Their data may also be communicated to third parties when transmission is carried out in compliance with a legal obligation, a decision-making of the National Data Protection Committee or another relevant control entity, or a court order; or when communication is carried out to protect vital interests of users or any other legitimate purpose provided by law.

CONSERVATION OF PERSONAL DATA

The personal data collected will be kept in Panacea software as they are needed to fulfill the objectives they motivated their collection, according to applicable laws.

Regardless, the data collected will be integrated by the physician to carry out the teleconsultation in the electronic clinical process of CBR Genomics maintaining these clinical records for the period determined by law. Its supply is optional and is guaranteed, in accordance with the law, the right of access, rectification and annulment of any data directly concerned, personally or written, directly to the constant address on the home page of this website.

USE OF CLINICAL DATA

The client grants CBR Genomics and, therefore, to KNOK, access to copy, transmit, process and store anonymous health data referring to the customer. These anonymous data may be used for:

      Scientific studies of academic scope.

      Analysis for predictive purposes and other uses related to service improvement.

      Diagnostic purposes.

      To test, improve and otherwise modify services, whether they are requested by the Client or not.

      The development of new services or improvements of the existing ones.

SECURITY

We are concerned with the privacy and safety in the treatment and transmission of user data, maintaining technical means in our power to avoid loss, misuse, change, unauthorized access, and undue appropriation of personal data provided or transmitted. In any case, it should be noted that, by circulating open Internet network data, it is not possible to eliminate the risk of unauthorized access and use, so that the user must implement adequate security measures when using Panacea.

INTERNET ACCESS, EQUIPMENT AND DEVICES

The user is responsible for obtaining Internet access as well as acquiring and updating the device (computer, smartphone, tablet, etc.) required to enable access and use of services of CBR Genomics provided by Panacea software.

The service in question presupposes uninterrupted user access to the Internet during service provision. CBR Genomics does not assume any responsibility for failure to the service in case of the user's inability to maintain uninterrupted Internet access.

EXTERNAL LINKS AND THIRD-PARTY SERVICES

Panacea software may contain external links that redirect the user to other Internet pages, on which KNOK does not exercise. Therefore, despite the previous and regular checks carried out by KNOK, the user acknowledges that KNOK will be exempt from any liability on the content found on the external pages.

Panacea uses cookies to improve the performance of it. Cookies allow the user to have a better browsing experience on our site. By using Panacea, you agree that we can use cookies.

Allow navigation in Panacea. Without cookies, the requested services may not be performed. Some cookies are essential to access specific areas.

Analytical Cookies

Cookies are used to analyse how users access Panacea and monitor their performance. This allows us to offer a high-quality experience by customizing our offer, identifying and correcting any problems that may occur. For example, we use development cookies to know popular pages, which the binding method between pages is more efficient or to identify some existing errors that may occur. Cookies are used only for statistical analysis, without collecting any personal information.

Functionality Cookies

This cookie collects and saves users’ preferences related to Panacea using users, allowing users to do not waste time in configurations before each use.

Third Party Cookies

These cookies measure the success of the efficiency of the advertisements of third parties. They can also be used to customize a widget with user data.

 

Cookies can be:

Permanent Cookies - Cookies are stored or saved for a variable period in the Internet browser on the device used (PC, Phone or Tablet) and are used each time the user accesses Panacea. They are usually used to target navigation according to the user's interests, allowing us to offer a better and more personalised service.

 

Session Cookies - Cookies are temporary and are stored in the Internet browser until the end of the use of Panacea. The information obtained allows us to identify problems and give solutions, allowing a better user experience.

 

How can you manage cookies?

As we explained, Cookies help get the most out of Panacea. The common browser allows the user to accept, refuse or delete cookies in the respective settings section. After authorizing the use of cookies, the user can totally, or partially, disable our cookies.

PAYMENT

The company uses third-party payment processors ("payment processor") that make available modalities of diverse payments.

 

The following payment methods are available via Easypay - Instituição de Pagamento Lda:

      Credit and debit card - Visa, Mastercard;

      Multibanco Reference;

      MBWay;

 

PROVISION AND CONSUMPTION

The availability of the service will be carried out after the receipt of confirmation of the payment.

PRICES

Prices should be understood in Euro, with fees and taxes included, considering VAT in force at the date of payment. If there is an increase in the prices of some service, the user will be informed immediately, and can choose to continue to enjoy the service (making the payment of the difference) or for cancellation of the service.

 

Medical Genetics:

The first teleconsultation in Medical Genetics (Genetic Counselling) has a cost of €100.00 (one hundred Euros)*. Any additional teleconsultations will cost €80.00 (eighty Euros) each*.

 

*In case of teleconsultations within the scope of DNA.files services, other specific conditions may apply. Please read the Terms & Conditions of the DNA.files services.

CANCELLATION AND REIMBURSEMENT

The cancellation or return process is treated on a case-by-case basis by CBR Genomics. The request must arrive in writing to the contact email cbra@cbrgenomics.com up to 2 days until the date of scheduling of the service, with the cancellation or return instructions of the amount paid answered and defined by CBR Genomics by the same means of communication.

Whenever possible the return should be carried out by the same way of payment, but if it is not possible, the user should have proof of payment and account holders or card, so that the return by bank transfer is carried out.

CBR Genomics undertakes to repay the user within the maximum term of 60 days.

UPDATES AND FEATURES

The user acknowledges that, at any time, Panacea may change, and such updates may result in modifications to your user interface and / or its features (including addition, modification, or removal of features, features or content).

AMENDMENTS TO THIS DOCUMENT

CBR Genomics reserves the right to, always and without prior notice and with immediate effects, change, add or revoke, partially or fully, this Privacy Policy.

Any changes will be disclosed immediately by this way.
